These Terms of Use (the “Terms”) are a legally binding agreement between you and Ashley Sims, LPC, of Little Lamp Christian Counseling LLC (“Little Lamp,” “we,” “us,” or “our”) regarding your access to and use of the website at www.littlelamp.org and any related media, channels, mobile sites, or applications (collectively, the “Site”). By accessing or using the Site you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Site.

1. Scope; No Counselor-Client Relationship; Intended Use

1.1. The Site is intended for informational and marketing purposes only. Content on the Site is not clinical, medical, or therapeutic advice and is not a substitute for professional diagnosis, treatment, or therapy.

1.2. Use of the Site, including any contact through email or a contact form, does not create a counselor–client relationship.

1.3. The Site and its Content may not be lawful to access from every jurisdiction. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

2. Privacy Policy

2.1. Hosting & Server Logs. The Site is hosted on Neocities.org, a static hosting provider. Neocities may collect minimal technical information necessary to operate hosting services (e.g., server logs such as IP addresses, timestamps, and request metadata) in accordance with Neocities’ policies. Little Lamp does not control Neocities’ platform-level logging or retention practices. Visitors should review Neocities’ privacy statement for details.

2.2. No Tracking / No Cookies (by default). Littlelamp.org does not use analytics tools, cookies, advertising trackers, or third-party tracking scripts by default. You will not be tracked for advertising or marketing purposes as part of routine Site browsing. If tracking, analytics, or cookies are later added to the Site, the change will be reflected in the privacy page and in the “Last updated” date of this Terms page.

2.3. Personal Information. Littlelamp.org does not collect, store, or share personal or sensitive information from Site visitors except when voluntarily provided by you. Any personal information you voluntarily provide will be used only to respond to your inquiry or to provide the requested information or service, and will not be sold to third parties.

2.4. Children. We do not knowingly collect information from children under the age of 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information.

2.5. International Transfers. If you access the Site from the European Union, the United Kingdom, or any other jurisdiction outside the United States, you acknowledge and consent that any personal information you provide will be transferred to and processed in the United States and is subject to U.S. law.

3. Intellectual Property & Copyright

3.1. Ownership. Unless expressly stated otherwise, the Site and all Content are the exclusive property of Little Lamp Christian Counseling LLC or its licensors, and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

3.2. Logo & Site Creation. The Little Lamp logo (the female figure with a lantern) was designed and created by Ashley Sims, LPC. The Site’s source code and implementation — including HTML, CSS, JavaScript, assets, and any custom code — were authored entirely by Ashley Sims, LPC.

3.3. Permitted Use. You are granted a limited, non-exclusive, non-transferable license to access and view the Site and to download or print one copy of Content solely for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices. Any other use is strictly prohibited unless you obtain our prior written permission.

3.4. Enforcement & Remedies. Unauthorized use, copying, distribution, or exploitation of our Content, logo, or code constitutes infringement. We will enforce our rights to the fullest extent permitted by law, including filing lawsuits, seeking injunctive relief, statutory and actual damages, punitive damages where available, seizure of infringing materials, and recovery of attorneys’ fees and costs.

4. Digital Millennium Copyright Act (DMCA); Notice & Takedown

4.2. What to Include in a DMCA Notification. A valid DMCA takedown notice must include the elements required by 17 U.S.C. § 512(c)(3), including: (a) signature, (b) identification of the copyrighted work, (c) identification of the allegedly infringing material and its location on the Site, (d) contact information, (e) statement of good-faith belief, and (f) statement under penalty of perjury.

4.3. Counter-Notification. If you believe content was removed by mistake, you may send a DMCA counter-notification that complies with 17 U.S.C. § 512(g)(3), including identification, consent to jurisdiction, statement of acceptance of service, name/address/phone, and statement under penalty of perjury.

4.4. Misrepresentations. Submitting a false DMCA notice or counter-notice may expose the sender to liability for damages, including attorneys’ fees.

5. User Representations & Acceptable Use

By accessing or using the Site you represent and warrant that you:

5.1. are at least 18 years old or otherwise have the legal capacity to enter into these Terms;

5.2. will comply with all applicable local, state, national and international laws and regulations in connection with your use of the Site;

5.3. will not use automated or non-human means (bots, scripts) to access the Site;

5.4. will not use the Site for illegal, fraudulent, or unauthorized purposes; and

5.5. will not attempt to gain unauthorized access to any part of the Site, other users’ accounts, or systems.

6. Prohibited Activities

You agree not to, and will not assist or enable others to, engage in any prohibited activities. Prohibited activities include (but are not limited to):

6.1. Systematically retrieving, scraping, or compiling Site data to create a competing database, directory, or product without our written permission.

6.2. Collecting, harvesting, or using other users’ personal information (including email addresses) for unsolicited communications.

6.3. Using the Site to advertise, sell, or offer goods or services without express written consent.

6.4. Circumventing, disabling, or interfering with Site security features or access controls.

6.5. Framing, deep-linking, or embedding the Site in a manner that implies sponsorship or endorsement.

6.6. Using the Site to defraud, mislead, or attempt to obtain sensitive account information.

6.7. Submitting false reports, abusing support channels, or otherwise misusing Site resources.

6.8. Deploying automated systems (bots, scrapers, spiders) to access or interact with the Site except as expressly permitted.

6.9. Interfering with or degrading Site operation or other users’ experience.

6.10. Impersonating another person or misrepresenting your affiliation with any person or entity.

6.11. Uploading or transmitting viruses, malware, trojans, or other harmful code.

6.12. Uploading tracking mechanisms (web bugs, 1×1 pixels, hidden gifs, or similar) intended to collect information about visitors without consent.

6.13. Deciphering, decompiling, reverse engineering, or otherwise attempting to derive source code from the Site.

6.14. Removing, altering, or obscuring copyright, trademark or other proprietary notices from any Content.

6.15. Using Site content in any manner that competes with Little Lamp or is for a commercial enterprise without prior written consent.

6.16. Harassing, threatening, or otherwise harming Little Lamp employees, contractors, or other users.

Violation of these prohibitions may result in account suspension, IP blocking, removal of offending content, and legal action.

7. Third-Party Websites and Content

7.1. The Site may contain links to third-party websites, resources, or services. These links are provided for convenience and do not imply endorsement. We do not control and are not responsible for third-party content, privacy practices, or terms. Visiting third-party sites is at your own risk.

7.2. Any purchases, interactions, or agreements you enter into with third parties you encounter through the Site are solely between you and that third party. You agree to hold Little Lamp harmless for any loss or damage arising out of those interactions.

8. Site Management; Changes; Termination

8.1. We reserve the right to monitor the Site, remove content, block access, or take any other action we deem appropriate to protect the Site, users, or our rights.

8.2. We may modify, suspend, or discontinue the Site or any portion thereof at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

8.3. These Terms will remain effective while you use the Site. We may terminate or restrict your access for any reason, including suspected violation of these Terms.

9. Disclaimers; No Warranties

9.1. THE SITE AND ALL CONTENT ARE PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LITTLE LAMP DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, and we disclaim liability for technical issues, inaccuracies, or omissions in Content.

9.3. Nothing on the Site is intended to create a clinician–client relationship, and Site content should not be relied upon as a substitute for professional mental health care.

10. Limitation of Liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LITTLE LAMP, ITS AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, OR COSTS OF PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2. IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100), OR (B) THE AMOUNT YOU PAID US FOR USE OF THE SITE DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. IF NO AMOUNT WAS PAID, THE LIMIT SHALL BE ONE HUNDRED U.S. DOLLARS.

11. Indemnification

You agree to defend, indemnify, and hold Little Lamp and its officers, agents, employees, affiliates, and contractors harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your violation of any third-party right (including intellectual property rights).

12. Dispute Resolution; Governing Law; Venue

12.1. Informal Negotiation. If a dispute arises between you and Little Lamp, we ask that you first contact us and attempt to resolve the matter informally. The Parties agree to attempt informal negotiation for at least thirty (30) days before initiating formal dispute resolution, except for matters that require immediate injunctive relief.

12.2. Arbitration. Except for disputes expressly excluded below, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by final and binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Franklin County, Ohio, unless the Parties agree otherwise. You and Little Lamp each waive any right to a jury trial or to participate in a class action.

12.3. Exceptions. The following claims are not subject to arbitration and may be brought in court: (a) disputes seeking to enforce or protect intellectual property rights; (b) claims related to theft, piracy, invasion of privacy, or unauthorized use; and (c) any statutory claims that cannot be compelled to arbitration under applicable law.

12.4. Governing Law; Venue. These Terms and any dispute not subject to arbitration shall be governed by the laws of the State of Ohio, without regard to conflict-of-law principles. If litigation is permitted, you and Little Lamp agree to the exclusive jurisdiction and venue of the state and federal courts located in Franklin County, Ohio.

12.5. Time Limit. Any claim or cause of action arising out of or related to the Site or these Terms must be filed within one (1) year after such claim arose, or it will be barred.

13. Corrections; Changes to Terms

13.1. The Site may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update information at any time without prior notice.

13.2. We reserve the right to modify these Terms at any time. The “Last updated” date at the top of this page reflects the current version. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. Miscellaneous

14.1. Entire Agreement. These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Little Lamp with respect to the Site.

14.2. Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.

14.3. No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4. Assignment. We may assign our rights and obligations under these Terms without your consent. You may not assign these Terms without our prior written consent.

14.5. No Agency. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Little Lamp.

15. Intellectual Property Violations

15.1. We take intellectual property infringement seriously. If we reasonably believe that you have used, copied, republished, or exploited our Content, logo, or code without authorization, we may take any remedial action available under law, including issuing cease-and-desist letters, submitting takedown requests, initiating litigation, seeking emergency injunctive relief, pursuing statutory damages and/or actual damages, and seeking recovery of attorneys’ fees and costs.

15.2. By using the Site you acknowledge that monetary damages may be inadequate to compensate for infringement and that injunctive relief may be necessary. We will pursue such remedies as appropriate and will not hesitate to file suit if necessary to protect our rights.

17. Acknowledgment
